They could very easily follow the method for things like this you might much American industry. The design belongs to the customer, in this case the Air Force and the company is just paid to design and execute the design. After that the design would be available to other manufacturers to do whatever they want to do with it. This occurs many times in industry with the design and any applicable patents belonging to the customer, the developer.
