The U.S. has had nukes since 1945, and has only used them twice. If they were copyrights, they'd have expired.

They have been considered for use many times since, with naval applications such as depth charges considered "conventional" and not needing the lengthy NCA release authorization.

Personally I think it's time we showed the rest of the world who's the big dog on the block, and use tactical nukes in Afganistan, and then anyplace else we meet resistance. Why play the game the bad guys want, and suffer needless casualties? The Muslim bomb eventually will be used, there is no doubt that if it was ready now, there would be NO hesitation with it's use. If we plan to co-exist with Muslim-based Governments and Tribal Associations, we'd better plan to do it with strength and plenty of power projection. WE are willing to live and let live on differences in religion, very unlike the non-U.S. Muslims, the ones dancing in the streets after the deaths of thousands of Americans (which by the way was FAR more widespread than reported by the media).

Colonel Kurtz in "Apocalypse Now" was right when he had the epihiany that showing the ability to do the unthinkable to your enemy pushes the limits of what you will endure further from you and closer to your enemy.
