Maybe the FAA will give you permission to fly a balloon and camera. There are no laws saying you can't apply to fly a balloon. The reason I don't think anyone taking telephoto shots from Tikaboo peak is charged with espionage is that Government moved back the publically accessible lands to the point where they feel they have negated the threat of photo taking. Here's what you need to think about. Will the people who are charged with keeping the base secure view your actions as a threat to their mission? If the answer is yes then you can expect to be on the receiving end of a hard time. Maybe they won't. If you were to go ahead with this I would suggest you may want to have at least a couple thousand dollars put aside for your legal defense as a precaution against misadventure. Like I said I hate being a buzz kill.
